About These Terms

These Terms & Conditions govern your access to and use of the Unique Eliapp website, your customer account and every order placed through the store. In these terms, “we”, “us” and “our” refer to Unique Eliapp, while “you” and “your” refer to the customer or website visitor.

Our current business and contact information is available on the Contact Us page. Please read these terms together with our Delivery Policy, Returns Policy and Privacy Policy before placing an order.

Accepting These Terms

By using the store or submitting an order, you confirm that you have read and accepted these terms and the policies incorporated into them. Before checkout is completed, you may review your order, correct errors or leave the checkout without placing the order.

If you do not accept these terms, please do not place an order or use features that require an account.

Eligibility & Customer Accounts

You must have legal capacity to enter into a contract. If you place an order for another person or organisation, you confirm that you are authorised to act for them.

You are responsible for providing accurate information, keeping your password confidential and notifying us promptly if you suspect unauthorised use of your account. We may suspend an account where reasonably necessary to protect customers, investigate fraud or prevent unlawful use.

Products & Availability

We aim to describe and display products accurately, including their main characteristics, materials, available sizes, colours and prices. Images are illustrative. Colour and appearance may vary slightly because of lighting, screen settings, natural materials or handmade production.

All products are subject to availability. Placing an item in your cart does not reserve it. If an ordered item becomes unavailable, we will notify you promptly and offer an appropriate alternative, back-order option or refund.

Prices, Taxes & Charges

Unless clearly stated otherwise, prices are displayed in GHS. The checkout will show the product price, delivery charge, discount, tax and any other applicable charge before you place the order.

We may correct genuine pricing or description errors. If an error affects an order already submitted, we will contact you before fulfilment so you may confirm the corrected order or cancel it for a refund.

Orders & Contract Formation

Your checkout submission is an offer to purchase the items in your order. An automated acknowledgement confirms that we received the order; it does not necessarily mean that the order has been accepted.

We accept the order when we expressly confirm it for fulfilment or dispatch it. We may decline or cancel an order before acceptance because of unavailable stock, an obvious pricing error, failed payment, suspected fraud, delivery restrictions or another legitimate operational reason. Where we cancel a paid order, we will arrange a refund.

Payments

Available payment methods are shown during checkout. Card and mobile-money payments may be processed by an authorised third-party payment provider. We do not store complete card or mobile-money credentials.

You confirm that you are authorised to use the selected payment method. An order may remain pending until payment is verified. Your bank, mobile-money operator or payment provider may apply its own terms, fees or processing times.

Promotions, Discounts & Store Credit

Promotion codes are subject to their stated validity period, eligibility rules, usage limits and exclusions. Unless stated otherwise, only one promotion may be applied to an order, promotions cannot be exchanged for cash and discounts do not apply retrospectively.

We may withdraw or correct a promotion where it was published in error, abused, obtained fraudulently or used contrary to its stated rules. This does not affect an order that we have already accepted unless the law permits otherwise.

Delivery

Delivery areas, charges, estimates, address requirements and failed-delivery procedures are explained in our Delivery Policy. Delivery dates are estimates unless we expressly agree to a fixed date.

Please provide a complete delivery address and reachable telephone number. You are responsible for information errors that cause delay or additional delivery cost, except where the error was ours.

Cancellations, Returns & Refunds

Your cancellation and return rights are explained in our Returns Policy. That policy includes the statutory grace period that may apply to electronic purchases, product-condition requirements, lawful exceptions, return costs and the refund process.

Nothing in these terms removes or limits a consumer right or remedy that cannot lawfully be excluded.

Order Records & Communications

We may provide order confirmations, receipts, invoices, status updates and policy documents electronically. You may save or print these records. Please retain your order number and contact details for support enquiries.

You agree that transactional messages may be sent to the email address or telephone number provided for the order. Marketing messages are separate and are sent only where permitted by law.

Website Use

You must not misuse the website, attempt unauthorised access, interfere with its operation, introduce malicious code, scrape it in a way that harms the service, impersonate another person or use the store for fraudulent or unlawful activity.

We may restrict access where reasonably necessary for security, maintenance, legal compliance or protection of other users.

Intellectual Property

The website design, brand assets, text, graphics, photographs and other content are owned by us or used with permission. You may access them for personal shopping purposes, but you may not reproduce, sell, publish or commercially exploit them without permission or another lawful basis.

Third-Party Services & Links

The store may connect to payment, delivery, social-media or other third-party services. Those providers operate under their own terms and privacy practices. We are not responsible for an independent third-party service, but we remain responsible for obligations that the law places on us.

Service Availability

We aim to keep the store available and accurate, but uninterrupted access cannot be guaranteed. We may perform maintenance, change features or correct content without notice where reasonably necessary.

Liability

To the fullest extent permitted by law, we are not responsible for loss caused solely by events beyond our reasonable control, misuse of a product contrary to its instructions, inaccurate information supplied by you or an independent third party outside our control.

We do not exclude liability for fraud, wilful misconduct, personal injury caused by negligence, breach of mandatory consumer rights or any liability that cannot legally be limited.

Events Beyond Our Control

We are not responsible for delay or failure caused by events reasonably beyond our control, including severe weather, transport disruption, public emergencies, utility or network failure, industrial action or government restrictions. We will take reasonable steps to reduce the effect and keep affected customers informed.

Complaints & Disputes

Please contact us first so we can try to resolve a complaint promptly. Include your order number, a clear explanation and any relevant evidence.

These terms are governed by the laws of the Republic of Ghana. If a dispute cannot be resolved directly, the parties may use any available alternative dispute-resolution process or a court with lawful jurisdiction. Mandatory consumer protections continue to apply.

Changes To These Terms

We may update these terms to reflect legal, operational or service changes. The version published when we accept your order normally applies to that order. The latest version and its updated date will remain available on this page.

Severability & No Waiver

If any provision is found unlawful or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not waive that right.
